Another sicko with a badge commits a heinous crime and gets off easy and we are supposed to trust law enforcement? Hell, we can’t even trust the justice system to properly punish them.
Last year, Alabama state trooper Samuel H. McHenry II was accused of raping a car accident victim and forcing her to perform oral sex. Thursday, he plead guilty to misdemeanor sexual misconduct and only has to serve six months. Here’s the real gut punch, besides the fact that the 182 day sentence must be completed within the next year, he’s free to choose the time increments of his sentence because he is not required to serve them consecutively.
Sure, he also lost his state certification and must register as a sexual offender on the agreement, but c’mon. Does the punishment really fit the crime? I don’t think so.
According to the allegations, McHenry was called to the scene Dec. 6 when the victim was involved in a car accident. Instead of helping the victim when he arrived at 10pm, he threatened to arrest her after spotting pill bottles and an empty nasal spray bottle in her vehicle. McHenry, like the sicko he is, saw an opportunity.
After placing her in the caged area of the squad car, he drove to an exit off Interstate 65 in south Alabama. Once he reached the new location, he opened the back door and told her, “Fuck me or go to jail.” According to the report, McHenry then pulled her pants down, raped her and forced her to perform oral sex.
On Dec. 7, the victim was just dumped near a closed store at another location around 1:45 a.m.
This sure seems like he had it planned out in his head pretty well. Kind of like he’s done this before, which isn’t hard to believe nowadays.
According to Williamson, one of McHenry’s attorneys, normally both sides agree to this kind of deal.
The normal thing is … this [deal] would not be done without the victim’s agreement and acquiescence. As I wasn’t privy to those communications, I don’t know in this case, but normally that would happen.
This sicko should not have even been offered such a lenient deal. Regardless of whether or not they both agreed to this deal, it still sends a bad message. Why would victims want to come forward knowing the person who assaulted them will get off with a slap on the wrist allowing them to be back on the streets again. This was definitely a FAIL!
